Avenue Fashion (a trade name of Nyota Imara Technologies, a general partnership registered in Kenya)

Effective Date: 1st July 2026

1. Introduction and Acceptance

Welcome to Avenue Fashion. By accessing or using our website at avenuefashion.co.ke, our mobile application, or any related services (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Platform.

These Terms constitute a legally binding agreement between you ("Customer", "you", or "your") and Avenue Fashion (Nyota Imara Technologies) ("we", "us", or "our"). We reserve the right to update these Terms at any time. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

2. Eligibility

You must be at least 18 years of age to create an account or make a purchase on the Platform. By using the Platform, you represent and warrant that you meet this requirement and that all information you provide is accurate, current, and complete.

3. Account Registration and Security

3.1 Nyota ID

Access to the Platform requires authentication via Nyota ID, our identity and account system powered by Supabase. Your account is personal to you and may not be shared or transferred.

3.2 Your Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at support@avenuefashion.co.ke if you suspect any unauthorised access to your account.

3.3 Account Termination

We reserve the right to suspend or terminate any account at our discretion, including for breach of these Terms, fraudulent activity, or abuse of the Platform.

4. Orders and Purchasing

4.1 Product Listings

All product descriptions, images, and pricing on the Platform are provided in good faith. We reserve the right to correct errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

4.2 Order Placement

Placing an order constitutes an offer to purchase the selected items at the stated price. An order is not confirmed until payment has been successfully processed and you receive an order confirmation by email and/or push notification.

4.3 Pricing

All prices are listed in Kenyan Shillings (KES) and are inclusive of any applicable taxes unless stated otherwise. Delivery fees are calculated and displayed at checkout based on your selected delivery location.

4.4 Order Cancellation

We reserve the right to cancel any order at our discretion, including in cases of pricing errors, stock unavailability, or suspected fraudulent activity. In such cases, a full refund will be issued to the original payment method.

5. Payment

We accept the following payment methods:

• M-Pesa
• Airtel Money
• Debit or Credit Card (via Paystack)

Payment must be completed in full before an order is processed. By submitting payment, you authorise us to charge the applicable amount to your selected payment method. All transactions are subject to the terms and conditions of the relevant payment provider.

6. Delivery

Delivery timelines and fees are governed by our Shipping Policy, which forms part of these Terms. We currently deliver within Kenya only. Risk of loss and title for purchased items passes to you upon delivery.

7. Returns and Refunds

Our returns and refund process is governed by our Returns Policy, which forms part of these Terms. Returns are subject to eligibility requirements, and refunds are issued to the original payment method where applicable.

8. Third-Party Sellers (Marketplace)

Some products on the Platform may be listed and fulfilled by independent third-party sellers ("Vendors"). When purchasing from a Vendor, your contract of sale is with that Vendor. Avenue Fashion acts as a marketplace facilitator and is not the seller of record for Vendor products. However, we maintain the right to mediate disputes and enforce our platform standards.

Vendor participation is subject to our separate Vendor Terms, and all Vendors are subject to a commission deducted from each sale.

9. Intellectual Property

All content on the Platform — including but not limited to text, images, logos, product descriptions, and software — is the property of Avenue Fashion (Nyota Imara Technologies) or its licensors and is protected under applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

10. User Conduct

You agree not to:

• Use the Platform for any unlawful purpose;
• Submit false, misleading, or fraudulent information, including fake reviews;
• Attempt to gain unauthorised access to any part of the Platform or its infrastructure;
• Scrape, harvest, or systematically extract data from the Platform;
• Interfere with or disrupt the integrity or performance of the Platform.

We reserve the right to remove any content submitted by users, including reviews, that violates these standards.

11. Product Reviews

By submitting a review, you grant us a non-exclusive, royalty-free licence to publish and display that content on the Platform. All reviews are subject to moderation and must reflect your genuine experience. Fabricated, defamatory, or abusive reviews will be removed.

12. Limitation of Liability

To the maximum extent permitted by Kenyan law, Avenue Fashion (Nyota Imara Technologies) shall not be liable for:

• Any indirect, incidental, special, or consequential damages;
• Loss of profits, data, or business opportunity arising from your use of the Platform;
• Delays or failures in delivery caused by circumstances beyond our reasonable control, including but not limited to force majeure events, carrier disruptions, or industrial action.

Our total aggregate liability to you for any claim shall not exceed the total amount paid by you for the specific order giving rise to the claim.

13. Dispute Resolution

We encourage you to contact us in the first instance at support@avenuefashion.co.ke to resolve any dispute informally. If a dispute cannot be resolved informally, it shall be submitted to the jurisdiction of the courts of Nairobi, Kenya, and governed by the Laws of Kenya.

14. Governing Law

These Terms are governed by and construed in accordance with the Laws of Kenya. Where applicable, we also have regard to internationally recognised data protection principles, including those reflected in the Kenya Data Protection Act, 2019, and standards analogous to the General Data Protection Regulation (GDPR).
